Divorce Cases: How HDB Flat Sales Usually Work
In Singapore, an HDB flat generally cannot be sold or transferred simply because a couple is divorcing. The outcome depends on the divorce stage and what the court orders for the flat.
1) Divorce Stage & What You Can Do

Before Interim Judgment (IJ)
You are still legally married. In most cases, HDB will not process a sale or transfer of the flat until Interim Judgment is granted.

After Interim Judgment (IJ) but Before Final Judgment (FJ)
The court may already have directions for the flat. HDB will usually proceed only when there is a clear court order stating whether the flat is to be sold or transferred.

After Final Judgment (FJ)
The divorce is concluded and property division is final. HDB will process the sale/transfer based on the court order and required eligibility checks.
Option 1: Sell the HDB Flat
Most common outcome. Usually requires Interim/Final Judgment and a clear court order stating the flat is to be sold. Sale proceeds are distributed based on the court’s instructions.
Option 2: Transfer to One Party
One spouse takes over the flat and buys out the other’s share. This is subject to HDB eligibility, loan approval, and CPF usage rules.
Option 3: Defer Sale (Rare)
The court may order a sale at a later date (e.g., child-related arrangements). Both parties may remain owners temporarily until the trigger event.
3) Minimum Occupation Period (MOP)
Often overlookedIf MOP is not fulfilled, selling is generally not allowed. However, divorce is one situation where HDB may consider allowing a sale on a case-by-case basis when supported by the proper court order.
- If MOP is fulfilled: resale process is generally straightforward once permitted.
- If MOP is not fulfilled: expect additional review and supporting documents.
